Who are we and what is our involvement?
We are an independent law firm specialising in Independent Legal Advice (ILA) on litigation funding agreements (LFA). We act independently from both the solicitors handling your claim or dispute and the funders who provide litigation funding, ensuring unbiased and clear guidance.
How is payment made?
You’re not required to pay our fixed fees upfront. Our fixed fee is usually funded through your LFA by your Funder and settled by your solicitors. Alternatively, you can choose to pay this out of your own funds if you would prefer for it to not be funded through the LFA.
What is Independent Legal Advice (ILA), and why do I need it?
ILA provides you with an impartial understanding of the terms and consequences of your litigation funding agreement. This guidance is crucial, especially given the legal and financial commitments involved in an LFA. Our role is to ensure you’re fully informed before you proceed.
What happens during the ILA consultation?
We’ll review your litigation funding agreement in detail, addressing any potential risks, costs, and obligations. You’ll have the opportunity to ask questions and clarify any terms, ensuring you understand the agreement fully before making a commitment.
Do I have to use LitFund Legal for ILA?
No, you have complete freedom in choosing your ILA provider. Our team specialises in litigation funding agreements, making us particularly well-equipped to guide you in understanding your LFA’s terms and implications. However, the choice of ILA provider remains yours.
If I don’t want to proceed after receiving advice, what happens next?
If you decide to cancel within 90 days of signing the LFA, your funder allows the agreement to be reversed. This process requires your solicitor to return the funds, effectively ending the agreement. It’s important to seek ILA to understand your rights in this process fully.
What if my solicitors stop acting – how can I understand my rights and obligations under the LFA?
If your solicitors are no longer acting, we can help you understand your rights and obligations under the LFA and outline the steps you need to take to protect yourself. This includes ensuring you’re aware of your responsibilities to avoid breaching the LFA and guidance on how to navigate any requirements the funder may have in these circumstances. We’ll work with you to address your obligations and assist you in making informed decisions to stay compliant and secure.
How long does the ILA process take?
Our ILA process is designed to be efficient and thorough. Depending on the complexity of your LFA and any questions you may have, most advice sessions can be completed within 30 minutes to 1 hour.
